Muster Rolls of Confederate Soldiers.
To whom it may concern:
Take notice that Thos. W. Smith, V. S. Kilby, A. P. Gomer and E. B. Britt have
filed petitions in the Clerk's Office of the Circuit Court of Nansemond County
praying that the muster rolls of Company A, 16th Virginia Infantry, Company
F, 3rd Virginia Infantry, Company F, 9th Virginia Infantry, Company E, 6th Virginia
Infantry, Company I, 13th Virginia Cavalry, Company B, 16th Virginia Infantry,
be recorded in the Clerk's Office of said Court, and that said petitions will
be heard by the Judge of said Court on the 14th day of May, 1908, at eleven
o'clock A. M.

Your petitioners, Thos W. Smith, V. S. Kilby and A. P. Gomer, three reputable
soldiers, who served in the defence of Virginia in the war between the states
in 1861 and 1865, respectfully represent that Company A, 16th Virginia Infantry
was organized, recruited or enlisted, in whole or in part, in the County of
Nansemond, State of Virginia, during the war between the states, and that said
Company A, 16th Virginia Infantry did actually serve in one of the armies of
the Confederate States of America, to-wit: Northern Virginia, a copy of the
muster roll of said Co. A, 16th Va. Infantry being herewith filed and made a
part of this petition.
Your petitioners, by virtue of an Act
of the General Assembly of Virginia, approved February 9th, 1898, entitled
"An Act having for its object the collection preservation and perpetuation
of the names of the soldiers of Virginia who fought in her defence in the war
between the states," do pray that the muster roll of said Co. A, 16th Va.
Infantry may be recorded among the records of said County.

Following is the muster roll of Company A. (Marion Rangers), Sixteenth Virginia
Volunteers, Mahone's Brigade, which left Suffolk on the 16th of April 1861 and
was mustered into service at Norfolk on the 19th of April, 1861 - This roll
was compiled by Messrs Benjamin F. Cutchin and John F. Lotzia and is full and
complete:
Captain Richard O. Whitehead; wounded at second Manassas. Promoted to Colonel.
Second Captain John Brenan; wounded October 27th, 1864; taken prisoner and died
at Washington, D. C.
The Company was then commanded by First Lieutenant Thomas W. Smith, who surrendered
it at Appomattox Courthouse. Living.

To the Honorable James L. McLemore, Judge of the said Court:
Your petitioners, Thos W. Smith, V. S. Kilby and A. P. Gomer, three reputable
soldiers, who served in the defence of Virginia in the war between the states
in 1861 and 1865, respectfully represent that Company I, 13th Virginia Cavalry
was organized, recruited or enlisted, in whole or in part, in the County of
Nansemond, State of Virginia, during the war between the states, and that said
Company I, 13th Virginia Cavalry did actually serve in one of the armies of
the Confederate States of America, to-wit: Northern Virginia, a copy of the
muster roll of said Co. I, 13th Va. Cavalry being herewith filed and made a
part of this petition.
Your petitioners, by virtue of an Act of the General Assembly of Virginia,
approved February 9th, 1898, entitled "An Act having for its object the
collection preservation and perpetuation of the names of the soldiers of Virginia
who fought in her defence in the war between the states," do pray that
the muster roll of said Co. I, 13th Va. Cavalry may be recorded among the records
of said County.
And your petitioners will ever pray, etc.
